The House Judiciary Committee, controlled by Committee Chairman Jerry Nadler (D–CA), issued a filing with the Supreme Court on Monday that seeks release of sealed grand jury evidence gathered during the Muller-Russia investigation.

House Democrats say the grand jury’s evidence is “central” to the Judiciary Committee’s inquiry into accusations against President Trump for obstruction of justice.

House General Counsel, Douglas Letter wrote:

“If this material reveals new evidence supporting the conclusion that President Trump committed impeachable offenses … the committee will proceed accordingly – including, if necessary, by considering whether to recommend new articles of impeachment.”

The letter indicated the committee is also considering investigating what it believes is the improper political influence of the Justice Department’s handling of cases against both General Michael Flynn and Roger Stone, two of Trump’s allies who were indicted during the nearly two-year-long Mueller investigation.

The Justice Department recently dropped the case against former national security adviser General Michael Flynn. Attorney General William Barr told CBS News: “A crime cannot be established here. They did not have a basis for a counterintelligence investigation against Flynn at that stage.”

House Democrats have been in a heated battle with the Justice Department over the grand jury evidence for months culminating in a federal appeals court ruling that the committee has a right to see the evidence.

By a split decision, the D.C. Circuit Court of Appeals ruled:

“The committee has established a particularized need for the redacted grand jury materials it seeks. The committee has repeatedly stated that if the grand jury materials reveal new evidence of impeachable offenses, the committee may recommend new articles of impeachment.”

The Senate acquitted President Trump on both “impeachable offenses” after months of Congressional theatrics in which Trump was accused of abuse of power for pressuring Ukraine’s president to investigate Hunter Biden and his father, former Vice President Joe Biden.

House general counsel Douglas Letter left the possibility open at a hearing in January that there could be new impeachment articles filed against President Trump. With the D.C. Circuit Court of Appeals ruling, it appears House Democrats are determined to make a new impeachment hearing a reality.

Nadler praised the ruling in saying, “The Committee remains committed to holding the president accountable to the rule of law and preventing improper interference in law enforcement investigations.”

Letter also derided the Justice Department’s handling of the Stone and Flynn cases. As a result, retired U.S. District Judge Emmet Sullivan has been chosen to challenge the Justice Department’s decisions.
